1. Introduction and Philosophy

At Vera Beauty Inc. ("Vera"), our mission is to raise the world's skin game through honesty, science, and empathy. Just as we value transparency in aesthetic treatments, we value the intellectual property rights of creators. We respect the copyright of others and expect the Users of the Vera app (including Patients and Providers) to do the same.

It is Vera's policy, in appropriate circumstances and at our discretion, to disable and/or terminate the accounts of Users who repeatedly infringe or are repeatedly charged with infringing the copyrights or other intellectual property rights of others.

2. Notification of Copyright Infringement (DMCA Notice)

In accordance with the Digital Millennium Copyright Act of 1998 ("DMCA"), the text of which may be found on the U.S. Copyright Office website athttp://www.copyright.gov/legislation/dmca.pdf, Vera will respond expeditiously to claims of copyright infringement committed using the Vera app or websites (collectively, the "Services") that are reported to Vera's Designated Copyright Agent. Upon receipt of the Notice as described below, Vera will take whatever action, in its sole discretion, it deems appropriate, including removal of the challenged material from the Services.

3. DMCA Notice of Alleged Infringement ("Notice")

To file a Notice, please provide the following information:

  1. Identify the Work: Identify the copyrighted work that you claim has been infringed, or—if multiple copyrighted works are covered by this Notice—provide a comprehensive list of the copyrighted works that you claim have been infringed.
  2. Identify the Infringing Material: Identify the material that you claim is infringing (or to be the subject of infringing activity) and that is to be removed or access to which is to be disabled. You must provide information reasonably sufficient to permit us to locate the material.
  3. Note: Please be as specific as possible (e.g., providing screenshots, usernames, or specific navigation paths within the Vera app, such as "Review by User [Username] on [Provider Name]'s profile").
  4. Contact Information: Provide your mailing address, telephone number, and, if available, email address.
  5. Good Faith Statement: Include the following statement in the body of the Notice:
"I hereby state that I have a good faith belief that the disputed use of the copyrighted material is not authorized by the copyright owner, its agent, or the law (e.g., as a fair use)."
  6. Accuracy Statement: Include the following statement in the body of the Notice:
"I hereby state that the information in this Notice is accurate and, under penalty of perjury, that I am the owner, or authorized to act on behalf of the owner, of the copyright or of an exclusive right under the copyright that is allegedly infringed."

5. Counter-Notices

If you believe that your content was removed (or access to it was disabled) by mistake or misidentification, you may send a counter-notice to our Designated Copyright Agent. To be effective, the counter-notice must be a written communication that includes the following:

  1. Identification of the material: The material that has been removed or to which access has been disabled, and the location at which the material appeared before it was removed or access was disabled.
  2. Statement under penalty of perjury: A statement that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
  3. Consent to jurisdiction: A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or the Northern District of California if your address is outside of the United States), and that you will accept service of process from the person who provided the original DMCA notification or an agent of such person.
  4. Signature and Contact Info: Your physical or electronic signature, your name, address, and telephone number.

If a counter-notice is received by the Copyright Agent, Vera may send a copy of the counter-notice to the original complaining party informing them that Vera may replace the removed content or cease disabling it in 10 business days. Unless the copyright owner files an action seeking a court order against the content provider, the removed content may be replaced, or access to it restored, in 10 to 14 business days or more after receipt of the counter-notice, at Vera's sole discretion.
